Terms and Conditions for Digital Products on Joyce Tsang Content Marketing Limited

1.0 Introduction

These terms and conditions specify the rules for using our website, our downloaded and streamed digital products, including their content (the "products"), between you, the customer, and Joyce Tsang Content Marketing Limited ("us," "we"). You fully agree these terms and conditions by using our website and by purchasing, downloading, and using our products. You should not use our website, buy, download, or use any of our products if you do not agree with these terms and conditions.

2.0 License and Use

Your purchase of one of our products entitles you to a non-exclusive, non-sublicensable, non-transferable license from us to download and/or access that product for your own personal use and reference, and in the case of digital downloads, to print the product or convert it to an image or vector format for your own storage, retention, and reference (the "purpose"). You agree that under no circumstances will you use, or authorize the use of, any product for a purpose other than what is stated above. To be clear, you are not permitted to duplicate, resell, sublicense, rent, share, or otherwise distribute any of our products—modified or unmodified—to any third party. You consent to refrain from using any of our products in a way that would be harmful to us or harm our reputation.

3.0 Intellectual Property

Regardless of whether they have been altered, the products, along with all of the associated intellectual property and copyright, are and will always be our sole and exclusive property. You acknowledge that you may not possess or make any attempt to possess any intellectual property rights or copyright in the product, regardless of whether the product has been modified.

4.0 Refunds and Chargebacks

Due to the electronic nature of our items, there is no right of cancellation or return after you have made a purchase. Any refunds will be given solely and completely at our discretion. You acknowledge and agree that you will never use your payment provider to request a chargeback. You acknowledge that any payments you make are final and cannot be reversed for any of our products. We have the right to change any of our prices.

5.0 Warranties and Liability

We make every effort to make sure that our products are reliable, accurate, and appropriate for our clients' use. However, we disclaim all liability for the product's suitability and make no claims or warranties, whether express, implied, or statutory, about its usage or functionality, including without limitation any warranties of merchantability or fitness for a particular purpose. You acknowledge that by violating these terms and conditions, you are exposing us to liabilities, claims, demands, expenses, actions, costs, damages, or loss. Additionally, we are not liable to you or any other party for incidental, indirect, special, or exemplary damages, including but not limited to losses in revenue, business, or anticipated benefits, whether such damages result from a tort (such as negligence), a contract, or another event, whether or not they were anticipated, foreseeable, or known to be possible.

You acknowledge that injunctive relief may be necessary to enforce the responsibilities set out in this agreement since you may not be able to monetary compensate us for any harm that results from your violation of these terms and conditions. Any other provision of these terms and conditions shall not be affected by the unenforceability of any one of them. We both irrevocably submit to the exclusive jurisdiction of the Hong Kong courts over any claim, dispute, or matter arising under or in connection with these terms and conditions or our relationship with you. Hong Kong law shall govern these terms and conditions, your acceptance of them, and our relationship with you.
